RULES AND REGULATIONS

 

These Terms and Conditions may change as we continue to evolve our business or external factors require us to do so. If we change these Terms and Conditions, we will post the revised document here on the Raw website and such changes will be effective immediately upon that posting. Your continued use of the website constitutes your acceptance of such changes and agreement to be bound by the modified Terms and Conditions. So we recommend that you review these Terms and Conditions periodically when accessing or using the facility.

 

THE CLUB

  1. The Club shall be known as Avena Leisure (hereinafter referred to as “the Club”.
  2. Members of the Club are bound as a condition of membership to comply with the rules set out below. This is to ensure that the facilities are properly and safely used and that all members enjoy full advantage of them without interfering with the enjoyment of others.
  3. The Club will be administered by its Manager and / or such persons as the Owner will decide.
  4. The Owner(s) has sole responsibility for the control and operation of the Club. The extent of the facilities of the Club and any additions, deletions, or replacements thereto shall be at the Owner’s sole discretion.

 

MEMBERSHIP

  1. Persons wishing to become members of the Club or renew an existing membership must fully complete an online application form provided by Avena Leisure. The person must also provide when asked: 
    1. 1. A current legitimate form of identification and / or proof of permanent residence in the form of an electricity bill / landline telephone bill.
    2. 2. A business identification to confirm proof / place of employment.
  2. Members are required to leave the pool and fitness floors 20 minutes before closing times if they wish to take a shower. 
  3. Management reserves the right to refuse an application for membership or any entry to the Club.
  4. Management reserves the right to terminate membership at any time for any reason we see fit. In addition to this management reserves the right to terminate membership due to non-compliance with these Terms and Conditions, including behavior deemed detrimental to the welfare, good order, or character of the club and its members. In addition, members must respect the Club’s health and safety measures outlined throughout the club, this is for the safety of the Clubs staff and members.
  5. The gym and its facilities shall not be abused or damaged in any way. Any damage caused to the Club’s property due to a reckless or negligent act will be paid by you.
  6. The Club shall have the right to suspend or withdraw Club privileges or membership from any Member who, in their opinion, has abused privileges or conducted himself or herself in a manner deemed detrimental to the Club staff or its Members. Such expulsion or suspension shall become effective immediately and no reimbursement will be issued to such Member of the pro-rated portion of their unused monthly fees. There will be no refund of the joining fee. The Manager or a designee shall have complete charge of the Club whilst on duty. Members may be suspended or expelled from the Club immediately if they display conduct which is, or is likely to be in the sole opinion of the Company, injurious to the character of the Club or the interests of the Members and staff, or if they commit a serious or repeated breach of these Rules, in particular where amounts owing to the Company are unpaid. An expelled Member forfeits all the privileges of the membership and all rights against the Club. An expelled Member will not be entitled to any refund of their joining fee or subscription and must pay all amounts owed to the Club. 
  7. The Owner and Management of the Club reserve the right to require any member, guest, or other person to leave the Club at any time.
  8. The membership year of the Cub shall run from such period or periods of 12 months as the Owner may determine from time to time. Membership not renewed within 14 days of its expiry is deemed to have expired. An expired membership may be renewed upon payment of the prevailing subscription fee plus the prevailing registration fee and if current membership levels allow.
  9. Membership is not transferable from person to person. Members should note that this provision includes the non-transfer of membership from one-person to another within the same family.
  10. By joining the Club, members automatically accept and agree to be bound by these conditions of membership.
  11. By joining the Club, members are consenting to the use of video and photo recordings both in the form of CCTV recordings and for potential use on social media.
  12. Membership is deemed active from the day on which payment has been made unless otherwise agreed by management.
  13. We recommend that before using the club you familiarise yourself with the fire exits and emergency routes in case of evacuation. Please note that employees are NOT required to “seek & search” the building. Therefore, it is the responsibility of each individual to follow the relevant instructions. Please note lifts will not be operational during an emergency evacuation. 
  14. Members are required to comply with the rules and follow health and safety guidance as displayed on the premises. All members must watch the Club’s health and safety video. This video will be sent to NEW members as part of their welcome email. Therefore, the Club needs your correct email address to join the Club.
  15. The Owner may withdraw the use of all or part of the facilities of the Cub for the purposes of undertaking maintenance or any other work considered necessary at any time. Compensation will not be given for any such closures.
  16. Members can use the Club facilities only at the times designated for each membership type.
  17. On acceptance of a membership application, the applicant shall be issued with a Membership Card that shall remain the property of Avena Leisure, and upon termination of the membership, shall be returned to Avena Leisure.
  18. All members must produce their Membership Card on each occasion if they wish to gain entry to the Club facilities.
  19. Members who lose their Membership Card must pay an administration fee of €10 to replace it. 
  20. If any member wishes to terminate his/her membership before it normally expires, no refund of the subscription will be made.
  21. The Owner and management of the Club reserve the right to restrict the number of persons using the Club or any part of it at any one time.
  22. The Club Management reserves the right to utilize the Club facilities for special events, classes, or other activities it may deem desirable.
  23. Adult membership is restricted to persons 18 years and over. The membership types, which are subject to change, include the following: 

 

  • Full Membership – Individual.
  • Student Membership – Individual (Over 16 full-time 3rd level).
  • Youth Membership – (12 to 15 years) as part of a family.
  • Junior Membership – (0 to 12 years) as part of a family.

 

  1. Our 14-day trial membership runs for 14 consecutive days only and is subject to availability. The availability is decided by Avena Management.
  2. Payment of monthly direct debits is due regardless of usage.
  3. In the event of default of payment, we reserve the right to re-apply for the outstanding amount from your bank account or credit card on any day throughout the month.
  4. Monthly members are subject to a monthly rolling contract and may not cancel their membership for the first 30 days of their first payment date. 
  5. After the first 30 days, your membership may be frozen for €7 a month for up to 90 days (90 days does not apply to annual subscriptions). At the time of freezing your membership, you must provide a reactivation date and on this date, your subscription will begin to charge you at your normal membership rate. This may be adjusted pro rata if you freeze or unfreeze in the middle of a billing period. If you have been a member of the gym for more than 30 days and wish to freeze your membership, you can do so via email to membership@avenaleisure.com. Please allow 12-14 working days before the billing period to allow for a freeze. Request for freezing shall be at the sole discretion of the Club. We require 12-14 days notice in writing (via our digital Freeze request form) to freeze a membership and the minimum time for freezing is one month. Members cannot apply to cancel while their membership is frozen.
  6. As for cancellations, all cancellations require a 30-day notice via the cancellation link upon your request to membership@avenaleisure.com this can also be done by visiting the club and completing the digital cancellation form. Monthly membership cancellations must be received by the 1st of each & every month. However, cancellations cannot be submitted in the same month as joining. One full calendar month’s payment is required which means a minimum of One month and a maximum of One month’s final payment will be necessary depending on the date the cancellation form is received. For example, if a digital cancellation form is received on the 1st of May, only May will be due. Cancellation requests must be made on a digital cancellation form which is available at Avena Leisure. You will receive an email confirmation within 2 working days of completing the digital cancellation form – until you receive this email the cancellation will not be valid. Membership cannot be amended whilst in the notice period. Verbal instructions to amend or cancel a membership cannot be accepted, all requests must be done via the digital cancellation form. Memberships can only be canceled if the subscription collection is up-to-date and active. Monthly fees and/or prepaid fees are not refundable. Please do not send a cancellation form by post. 
  7. Your data privacy and security are important to us. Please refer to our Privacy Notice which explains how we collect, store, and handle your personal data.
  8. CCTV Closed circuit cameras operate throughout the Club (except in the changing areas) (see our privacy notice for more information). Any unlawful activity within the Club may be reviewed for possible legal action.

GUEST POLICY

  1. Members and guests are encouraged to make any comment or complaint via email to membership@avenaleisure.com. Please ensure that all contact details are detailed in the email so a member of our team can contact you accordingly to discuss. Should a Member wish to discuss any issue in person they can also request to speak to the manager on duty. Members and guests may also contact the General Manager. It is our aim that we respond within 48 hours of receiving a comment or complaint. All written and verbal complaints are discussed at the club’s weekly team meeting every weekday and tracked until resolved. These Terms and Conditions apply to members and guests of the Club, both referred to as ‘members’ throughout. Since August 1st, 2024 there will be NO guest passes / Free trials for Non Members due to the safety of our members. Therefore, all past day passes (current circulation) will be deemed expired.
  2. Subject to availability, each member shall be entitled to purchase up to two guest memberships at any one time for use by guests to the Club All guests must complete a Guest Registration Form at reception before using any facility and a Physical Activity Readiness Questionnaire (PAR Q) before using the Club. The charge for guest membership will be displayed a reception and is subject to change without notice. Only a member may purchase a guest membership.
  3. All guests are bound by the Club rules. Members shall at all times be responsible for their guests while on the Club premises and shall ensure that such guests comply with the Club’s rules and conditions of membership Members must accompany their guests while they are using the Club. 
  4. Members shall not introduce a guest who has been refused membership of the Club or whose membership has been terminated without first obtaining approval from the Club Manager. 
  5. Members intending to bring guests to the Club should book their guests in advance in person or by phone, subject to the above. 
  6. Guests are permitted to use the gym on completion of a PAR Q as outlined above.

 

SAFETY & HYGIENE

  1. Members shall not use the facilities of the Club, while under the influence of alcohol, anti-coagulants, anti-histamines, vasa-constrictors, narcotics, tranquillizers, or any similar substances. 
  2. Members with diabetes, heart problems, high/low blood pressure, on strong medication, or who have any form of medical condition should consult their doctor before using any of the Club’s facilities. 
  3. Members are particularly advised not to undertake strenuous activity for which they might be medically unfit and the Owner will no any way be responsible for any harm that may come to a member as a re him/her undertaking, within the Club, any activity which is beyond his physical capacity. Members are advised to have a medical check-up and be partaking in strenuous activity. 
  4. Members are advised to allow one hour after partaking of a meal before using the Club’s facilities. 
  5. Members must use the shower and foot spray before entering the swimming pool area.
  6. No food or drink is to be brought into any part of the Club and only food and drink purchased in the Club may be consumed on the premise designated areas.
  7. Smoking is prohibited in all areas of the Club. 
  8. In the interest of hygiene, swim caps must be worn in the pool at all times.
  9.  In the interest of hygiene, health, and safety appropriate footwear must be worn in the pool area. 
  10. The use of the Club and its facilities is at the member’s own risk and we shall have no liability for any loss, injury, or damage sustained by the member. The Club, its members, employees, and third-party agents are indemnified against any action or claim arising in injury, loss, damage, or death as a result of the member using the gym facilities.
  11. Members and future members, guest passes must warrant and represent that they are in good physical condition and capable of engaging in exercise and notify a member of the fitness team immediately in order that Member/guest notes and their programme can be updated or medical clearance obtained. If through injury or other reason, such as pregnancy, this is not the case, they must consult a doctor before engaging in exercise and that he/she knows of no medical or other reason why he/she is not able to engage in active or passive exercise and that such exercise would not be detrimental to his/her health, safety, comfort or physical condition. The Member shall not use any Club facilities whilst suffering from any infectious or contagious illness, disease, or other ailment or whilst suffering from a physical ailment such as COVID-19, open cuts, abrasions, open sores, or minor infections where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other Members. 

 

DRESS CODE

  1. Members and guests are required to dress properly, and appropriately for the various Club activities and areas.
  2. Appropriate clothing and sports shoes are required when using the gym. 
  3. Swimwear must be worn in the Sauna, Steam room, and Jacuzzi. 
  4. Flip-flops must be worn in the wet areas.

 

CODE OF CONDUCT 

  1. All members are expected to behave properly in the interest of the correct use and enjoyment of the Club. 
  2. Any member whose conduct is considered by the Owner or Management to be detrimental to the best interests of the Club or its reputation may have his/her membership suspended or terminated at the discretion of the Owner or Club Manager. 
  3. It is expected that all members, guests, and staff of the Club will treat each other with mutual respect in order to create a positive and enjoyable atmosphere. Aggressive or bullying-type behavior will not be tolerated and will result in termination of membership. 
  4. Mobile phones may not be switched on in the pool, gym, treatment rooms, or fitness studios. 
  5. All Members MUST have a towel on entry – NO TOWEL NO ENTRY RULE will apply to every user, all members must wipe down machines before and after use. Members are NOT allowed to have Gym bags on the Gym floor.
  6. The minimum required age to join the Club is 16+ with parental consent.

 

OPENING TIMES 

  1. Public Holiday opening hours are the same as on Sundays 
  2. The times at which any of the Club’s facilities shall be available to members and guests shall be at the discretion of the Owner and are subject to change without notice. 
  3. The Owner reserves the right to alter the opening hours of the Club. Members must vacate all Club facilities 20 minutes before closing to allow for showering and changing.
  4. From time to time Management will allocate specific times to the different types of membership.

 

ANIMALS AND PETS 

  1. With the exception of guide dogs, animals, and pets are not permitted in any part of the Club.

 

LIABILITY 

  1. Each member and guest engaged in the activities of the Club or making use of its facilities is responsible for ensuring that he/she is properly equipped and that his/her state of health and physical condition are such as not to involve any risk to him/her self nor any other person making use of the Cub. 
  2. The Club accepts no liability for accident, injury, or misadventure caused to any person while using the Club. Members and guests are responsible for their own insurance arrangements in respect of any injuries, which may be suffered by them, or caused, to them by any third party, while using the Club facilities. 
  3. Lockers are provided in the changing rooms for use by members and guests. Items left in lockers overnight will be removed, placed in “Lost Property, and donated to a local charity if not claimed within seven days. Please do not leave items on top of lockers. The Club does not accept any responsibility for loss or damage to goods belonging to any member or guest. In particular, the Club does not accept responsibility for loss or damage to the valuables of any person while on the Club premises, even if said items were placed in a locker. 
  4. Lockers are provided for daily use only and may not be left in lockers overnight. Unclaimed property is kept on the premises for a maximum of 7 days and then is donated to charity.

 

VARIATIONS

  1. The Owner and Management reserve the right to amend and add to the conditions of memberships as it sees fit and members and guests shall observe any amendments or additional conditions or rules so made. 

 

COMPLAINTS AND DISPUTES

  1. Any complaint, dispute or difference about the interpretation of these terms and conditions of membership and rules and regulations shall be referred to the Management or Owner of the Club as appropriate, whose decision shall be final and binding and correspondence shall be entered into. 

 

GOODS FOR SALE & FOR HIRE

  1. A range of leisure goods is available for sale at reception. 
  2. Towels may be hired at reception for a small fee. 

 

PARTICULAR FACILITIES 

Swimming Pool 

  1. In the interests of hygiene, users of the swimming pool are required to shower and use the foot spray before entering the pool area. Diving and any misconduct which interferes with the proper use and enjoyment of the pool are strictly forbidden. 
  2. Swim caps must be worn in the pool at all times. 

Fitness Suite (Gym) 

  1. For safety reasons, this area must be kept dry. Users are therefore forbidden from entering while wearing wet clothing. Members and guests are required to carry and use a towel while using the gym and to wipe down each machine after themselves. 
  2. The booking of a Fitness Assessment is available at reception.24 hours notice of cancellation must be given. 

Jacuzzi, Sauna & Steam Room 

  1. Swimwear must be worn in the Jacuzzi, Sauna, and Steam Room by members and their guests. 

Group Fitness Studios 

  1. Appropriate clothing and footwear for the class in which you intend to participate should be worn. Participants are advised to bring a towel and water to drink. For safety reasons entry to the studio will not be permitted once a class has begun. 

CLUB USAGE 

  1. The Owner or Management shall determine the number of persons using the Club or any of its facilities at any time. 

YOUTHS AND JUNIOR MEMBERS 

  1. Membership for persons under 18 can only be accepted as an addition to an adult membership. 
  2. Members and guests aged 16 – 18 years may use the Gym under the guidance of a Club Fitness Instructor 
  3. Members and guests aged under 16 years may not use the jacuzzi Sauna or Steam Room. 
  4. Members and guests aged under 16 years must be accompanied in the Club by an adult member at all times and may not use Jacuzzi, Sauna, or Steam Room. 
  5. Members and guests aged under 16 years must be accompanied by an adult in the pool at all times. 
  6. All children under 18 are permitted to use the pool between 9.00 am and 7.00 pm only, all children must be vacated from the pool area before 7.00 pm. 

 

ALL MEMBERS 

  1. The terms and conditions of membership and rules & regulations contained herein apply to all members and guests alike, subject to any restrictions as defined.

Our Privacy Notice applies to the personal data that Avena Leisure collects and uses.

References in this Privacy Notice to “The Club”, “we”, “us” or “our” means Avena Leisure (a company registered in Ireland and registered office at 2 Burton Hall Road, Sandyford, Dublin 16, Ireland) We control the ways your personal data are collected and the purposes for which your personal data are used and are therefore the “data controller” for the purposes of the GDPR 2018, Data Protection Act 1998 and any other applicable European data protection legislation.

Special categories of personal data:

In the course of providing services to you, we may collect information that is considered “special categories of personal data” e.g. completion of a health questionnaire prior to a workout. We only collect this information where you have given your explicit consent, it is necessary to protect your vital interests, or you have deliberately made it public. If you do not allow us to process any special category personal data, this may mean we are unable to provide all or parts of the services you have requested from us.

 

How and why we use your personal data

To fulfill contractual obligations and provide our services to you.

Club membership is a contract between the Club and each individual member, so we may require your personal data, in order to issue you a membership unique to you, to allow you club access, and to enable us to verify your identity when necessary. Members are required to download the Club Plus app and follow the steps to ensure the app is set up correctly.

 

To communicate with you and manage our relationship with you

We may need to contact you by email, phone, letter, and/or SMS for administrative, customer service, or operational reasons, please be aware that these communications are not made for marketing purposes and as such, you will continue to receive them even if you choose not to receive marketing communications.  Examples of these include; changes to pricing structure or unplanned club closures.

We will also use your personal data to contact you after you have visited the club as a guest, made a booking for; a class, sent us a request, filled in a web form through our website, or contacted us on social media.

Your opinion is very important to us, so we may send you an email or SMS to seek your feedback.

We will use the communications you exchange with us and the feedback you may provide in order to manage our relationship with you as our customer and to improve our services and experiences for other members and guests.

Having a named company contact for our suppliers and/or corporate accounts means we can communicate more efficiently with you for payment purposes or with any account queries. As a named company contact at a company in the vicinity of one of our sites, means we can liaise with you directly to negotiate benefits and offers exclusive to your employees and keep track of any negotiations.

If you attempt to join online or make a booking, then you leave our website before this has been finalised, we may contact you in order to help you easily complete your transaction.

 

To personalise and improve your customer experience

We may also collect information on how you use our website, which pages of our website you visit most, which classes you attend/book, and what services you use/purchase, in order to understand what you like. We may use this information to tailor the content and offers that you see on our website and to send you relevant messages that we think you might like.

To raise awareness and enable you to share your achievements with others, we post photos and/or videos on social media, of any special events or challenges that we organise. Please be aware that if you take part, you may be included in these.

 

To inform you about our news and offers that you may like

As part of our service, we will email you with club news and offers that we have negotiated for our members and guests.  If you do not wish to receive this additional information, you can; opt-out at the point of sale, by emailing membership@avenaleisure.com to update  your preferences or choose the ‘opt out/unsubscribe’ option present on our email, reply STOP or UNSUBSCRIBE to any email/text contact.

As a previous member, we may contact you up to 24 months after your membership end date, if we have a re- joining offer exclusive to previous members.

If you have not made a purchase from us, we will only contact you via SMS/email/phone with updates, such as; offers and events IF you have consented to this (with the exception of direct response to a query). You can ‘unsubscribe’ to contact us at any time by choosing the ‘opt out/unsubscribe’ option present on our email, replying STOP, or UNSUBSCRIBE to any email/text contact.

To improve our services, for administration purposes, and to protect our business interests 

The business purposes for which we will use your information include accounting, budgeting, billing and audit, credit or other payment card verification, safety, security, statistical and marketing/profiling analysis, systems testing, maintenance, ordering of supplies, planning, and development.

As part of our GDPR, privacy policy 2024 all expired membership account data will be deleted within the first 24 – 72 hours of expiring membership with the Club unless instructed otherwise. If you wish to keep your data with Raw you will need to do so by contacting membership@avenaleisure.com

 

To comply with any other legal obligations.

Other – CCTV

The Club has CCTV installed in public areas (not changing areas).  Recordings are stored on a secure server for a maximum of 1 month for the purpose of security.

Purpose of CCTV

  • Ensure the safety and security of our members, visitors, and staff.
  • Prevent and detect crime and anti-social behaviour.
  • Assist in the effective management and operation of the gym.
  • Protect our property and assets.

Scope

This policy applies to all employees, members, visitors, and contractors at the Club.

  • CCTV System Description
  • Our CCTV system comprises fixed cameras located throughout the premises.
  • CCTV cameras are positioned to capture images that are relevant to the purposes stated above.
  • The system operates 24 hours a day, 7 days a week.

The processing of CCTV footage is necessary for the purposes of legitimate interests pursued by The Clubs, which include ensuring the safety and security of individuals and property.

Data Protection Principles

In line with GDPR, we adhere to the following principles:

  • Lawfulness, Fairness, and Transparency: We process CCTV footage lawfully, fairly, and transparently.
  • Purpose Limitation: CCTV footage is collected for specified, explicit, and legitimate purposes.
  • Data Minimisation: Only footage necessary for achieving the stated purposes is collected.
  • Accuracy: We ensure that CCTV footage is accurate and kept up to date.
  • Storage Limitation: Footage is retained only as long as necessary for the purposes it was collected.
  • Integrity and Confidentiality: We implement appropriate security measures to protect CCTV footage.

Retention Period

CCTV footage is retained for a maximum of 30 days, after which it is securely deleted unless required for an ongoing investigation or legal proceedings.

  • Access and Disclosure
  • Access to CCTV footage is restricted to authorised personnel only.
  • Footage may be disclosed to law enforcement agencies where required by law.
  • Individuals have the right to request access to CCTV footage that contains their personal data, subject to verification of identity and other legal considerations.

 

Individual Rights

Under GDPR, individuals have the following rights regarding their personal data:

  • Right of Access: Individuals can request access to their personal data.
  • Right to Rectification: Individuals can request the correction of inaccurate personal data.
  • Right to Erasure: Individuals can request the deletion of their personal data in certain circumstances.
  • Right to Restrict Processing: Individuals can request restriction of processing in certain circumstances.
  • Right to Object: Individuals can object to the processing of their personal data.

 

Sharing your personal data

Your personal data may be shared with other companies within our Group. Ashbourne Management system for the processing of monthly direct debits and Stripe for initial payments or additional products in the club.

We may also share some of your personal data with, or obtain your personal data from, the following categories of third parties:

  • Your employer or health club benefits provider, if your membership is via a corporate scheme and the Club invoices them for your membership subscriptions.
  • Bank/credit or debit card companies – in order to process your payments for services.
  • Credit control company – with prior notification, should contracted membership subscriptions or payment for goods or services become overdue (as per our T&C’s).
  • Web servers/website providers – hosting/storing some personal data.
  • IT support company – able to access some information to assist with IT issues.
  • Social media site – hashed email matched to account to create custom audience file
  • Profiling company – some of your data may be temporarily shared to ensure the relevance of marketing communication and profiling to enhance our targeting

In addition to the categories of recipient listed above, we may disclose your personal data when this is required by the law of any jurisdiction to which the Club may be subject.

 

Data transferred outside the EU
